At NearNow, we respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard your data when you use our website, mobile application, and related services (collectively, the “Platform”).

By using NearNow, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.

1. Information We Collect

Information You Provide:

·         Account information (name, email, phone number, date of birth / age verification)

·         Profile information (photos, bio, interests/tribes, vibes)

·         Event data when you host or post events (title, description, location, photos, date/time)

·         Payment information (processed securely via Stripe — we do not store full card details)

·         Communications with hosts or other users

Private Identity Selections (Tribes): During onboarding and in your settings, you may privately select identity categories (sometimes called “tribes”) such as LGBTQ+, sober/recovery, faith-based groups, or similar. These selections are stored only on your account, are visible only to you, and are used solely to personalize the events and communities shown on your own map. They are never displayed on a public profile, never shared with hosts, and never shared with other users.

Sensitive Personal Information – Community-Only Events: When you RSVP to a community-only event, you provide an affirmative signal (via explicit consent) that you belong to the host-specified community (for example, LGBTQ+, sober/recovery, or faith-based groups). This process may involve the collection and processing of sensitive personal information, including sexual orientation, religious or philosophical beliefs, or health-related information (such as recovery status). We only process this information to the extent necessary to facilitate the community-only event feature and only after you have given clear, informed consent at the point of RSVP. Your private identity selections themselves are never transmitted to the host.

Automatically Collected Information:

·         Location data (with your permission) to show nearby events

·         Device information, IP address, and usage data

·         App usage analytics (events viewed, RSVPs, etc.)

Cookies and Similar Technologies: We use cookies and similar technologies to improve your experience, maintain your session, and analyze usage.

2. How We Use Your Information

We use your information to:

·         Provide and personalize the NearNow experience (match you with events and tribes)

·         Process RSVPs, tickets, and payments

·         Enable communication between guests and hosts

·         Improve our Platform through analytics

·         Ensure safety and enforce our Terms of Service and Community Guidelines

·         Comply with legal obligations

Private Identity Selections: We use your private identity-tribe selections solely to personalize the content and events shown on your own map. They are never used to identify you to other users or hosts.

Community-Only Events: When you RSVP to a community-only event after providing explicit consent, we use that affirmative signal solely to confirm to the host that you belong to the specified community. We do not share your underlying private identity selections, profile details, or other sensitive attributes.

3. Sharing Your Information

We do not sell your personal data. We may share information in these limited cases:

·         With event hosts (limited attendee details for events you RSVP to — never your private identity selections)

·         With service providers (Stripe for payments, hosting providers, analytics tools)

·         For legal reasons (court orders, safety concerns, etc.)

·         In the event of a business transfer (merger, acquisition, etc.)

4. Data Security

We use industry-standard security measures to protect your data. However, no system is 100% secure. You are responsible for keeping your account credentials safe.

5. Your Rights and Choices

·         Access, Correction, Deletion: You can view and update your profile and private identity selections at any time. You may request deletion of your account and all associated personal data (including sensitive personal information) through Settings → Delete Account. Deletion is permanent and includes your identity-tribe selections.

·         Location: You can disable location services at any time in your device settings.

·         Marketing: You can opt out of promotional communications.

·         21+ Platform: NearNow is intended for users 21 and older. We may use age-related information to enforce eligibility.

·         Sensitive Personal Information: You may limit the use of your sensitive personal information (including identity selections) by removing them from your profile or deleting your account. We do not use sensitive personal information for advertising or sell it.

California and other state residents may have additional rights under applicable privacy laws, including the right to limit the use of sensitive personal information under the California Privacy Rights Act (CPRA).

6. Children’s Privacy

NearNow is not directed to children under 21. We do not knowingly collect data from minors under 21. If we learn we have collected such data, we will delete it.

7. International Users

If you are outside the United States, please note that your information will be transferred to and processed in the United States.

8. Changes to This Privacy Policy

We may update this policy from time to time. We will notify you of material changes by posting the new policy on the Platform and updating the effective date.
