Please put “DMCA Notice” in the subject line of any email.
2. What a notice must include
To be effective under 17 U.S.C. § 512(c)(3), a notification of claimed infringement must be a written communication to the designated agent that includes substantially the following:
A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by one notification, a representative list of such works.
Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit NearNow to locate the material (for example, the event URL or a screenshot plus the event title and date).
Information reasonably sufficient to permit NearNow to contact the complaining party, such as an address, telephone number, and email address.
A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. What we do with a valid notice
Upon receipt of a notification that substantially complies with Section 2, NearNow will act expeditiously to remove or disable access to the allegedly infringing material and will take reasonable steps to notify the user who posted it.
NearNow maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
4. Counter-notification
If your material was removed or disabled as a result of a DMCA notice and you believe that removal was a mistake or that you have the right to post the material, you may send a counter-notification to the designated agent at legal@nearnow.events. A counter-notification must include substantially:
Your physical or electronic signature.
Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access was disabled.
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which NearNow may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
After receiving a valid counter-notification, we will promptly forward a copy to the original complainant and inform them that we will restore the material in 10 business days. We will restore the material no earlier than 10 and no later than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the complainant has filed an action seeking a court order to restrain the alleged infringement. Your counter-notification, including its contact information, will be shared with the complainant.
